Definitions For the purposes of this Agreement:
“Website User” or “You” means the individual or business entity that is using or accessing the Intuit Conversion Services or the Website, including its employees and agents.
“AccSource”or “We” means Zanida Nominees Pty Ltd trading as AccSource.
“Conversion Services” or “ Services” means the provision of services to convert one unique accounting data set from one third party software package to Intuit products for compilation purposes.
“Source data” means any data inputted or uploaded by You or with your authority into the Website.
“Output data” means any data converted to Intuit (in the Cloud) and/or uploaded into the AccSource Website
"Effective Date>" means the date which you upload Source Data to the Website.
"Conversion Duration" means the period from the Effective Date until this Agreement is terminated in accordance with the provisions herein.
“Job Notification Number” means a computer generated number which our Website will send to the Website User using the email address provided on our Website
Conditions for Usage of Services:
To access these services, you must provide the necessary information online (including without limitation to e-mail address and phone number) and accept these Terms of Service from the Effective Date.
You may access the services on our websites on behalf of others or in order to provide services to others. If you access the services on behalf of others, it is your responsibility to ensure that you have proper authorization from other parties and that all parties for whom or to whom services are provided comply with and accept all terms of this Agreement that apply to you.
You must ensure that the Job Notification Number issued to you and all other information required to access Source Data and Output Data on the Website are kept secure and confidential. AccSource will not accept any liabilities as a result of your failure to safeguard the information.
When using Conversion Services on the Website, you must not:
Attempt to undermine the security or integrity of the Website;
Attempt to gain unauthorized access to any materials other than those to which you have been given express permission to access;
Attempt to transmit or input into the Website any files that may damage any other person’s computing devices or software, any content that may be offensive, or any material or Source Data in violation of any law
Upload or transmit as part of Source Data or otherwise any data, text, graphics, content, or material that: (i) is false or misleading; (ii) is defamatory; (iii) invades another's privacy; (iv) is obscene, pornographic, or offensive; (v) promotes bigotry, racism, hatred, or harm against any individual or group; (vi) infringes another's rights, including any intellectual property rights; (vii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (viii) spreads messages of terror or depicts torture; (iv) harm minors in any way, this includes any form of child pornography; (x) promotes illegal activity, including but not limited to, gambling and the offering for sale of illegal weapons
Access, tamper with, or use any non-public areas of the Services or AccSource's computer systems or the technical delivery systems of AccSource's providers;
Interfere with, or attempt to interfere with, the access of any Website User, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Website; or
Misuse system resources including, but not limited to, employing content which consume excessive CPU time or storage space; utilizing excessive bandwidth; or resale of access to content hosted on AccSource’ s servers.
Impersonate or misrepresent your affiliation with any person or entity.
You agree to defend, indemnify, and hold harmless AccSource, its affiliates, officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to the Website or use of the Services, or your violation of these Terms of Service.

The Information we collect
AccSource collects personal information (Information) in various circumstances and in various forms.
By the very nature of the accounting and taxation work we perform, we will be provided with personal information relating to clients and their family members, suppliers and customers, business partners, contactors, agents, etc. All this information is supplied to us by our clients or, in some circumstances, by other providers authorized by our clients.
The Information we collect and hold will depend on the nature of the particular services we provide to a client. In addition to basic identity and contact details (such as name, address, age, phone numbers, email address, education, qualifications, etc) we will collect and store other personal information such as income, personal and business expenditure, as well as employment history.
How we use Information
We use personal information primarily to be able to properly provide the professional services we have been contracted to provide for our clients. Without access to this Information, we will not be able to provide our accounting and taxation services.
We do not collect Information that is irrelevant or unnecessary to our business.
If at any time AccSource is required by law to release Information, AccSource must co-operate fully with the relevant authorities.
The contact details (First and last name, email address and phone number) that you provide to us when you submit the Conversion form are only used to contact you during the Conversion. Your contact details will never be shared with any other third parties.
The Personal Data information that is contained in the Source data file is only used for the purpose of our Conversion service. It is only shared with Intuit, during the Conversion process, and the result of the Conversion will be stored in Intuit servers.
We will unconditionally not sell, rent, trade, swap or otherwise supply to any third parties any personal information obtained from you, other than as explained in this Privacy Policy.
In cases where there are technical issues with the import of your file, AccSource may be required to work directly with Intuit in the resolution of the technical issues in order to move your data online. In this case, AccSource will, as required, share the source data file with Intuit technical staff in order to resolve the technical issue. In uploading your file through our site, you confirm and acknowledge that we might be required to share the source data file with Intuit technical staff.
Data retention
The contact details (First and last name, email address and phone number) that you provide to us when you fill the form will be stored securely to ensure that we are able to assist if you contact us even after the Conversion is complete.
The Personal Data information that is contained in the Source data file will be automatically deleted from all our systems within the calendar month following the completion of the Conversion.
Access, Correction, Deletion of your personal information
We respect your privacy rights and provide you with reasonable access to the Personal Data that you may have provided through your use of our Conversion Services.
If you wish to access or amend any Personal Data we hold about you, or to request that we delete any information about you that we have obtained from our Conversion Services, you may contact us at qboconversion@accsource.net . At your request, we will have any reference to you deleted or anonymized in our database.
AccSource will deal with all requests for access, correction or deletion of personal information in a prompt and timely manner, and will not charge for these services.
Data Controller and Data Processor
Because AccSource is mandated by Intuit to process (using tools provided by Intuit) Source Data files for Conversion into Intuit, AccSource is not acting in the capacity of data controller in terms of the GDPR and does not have the associated responsibilities. AccSource should be considered only as a processor on behalf of Intuit as to any Source Data files containing Personal Data that is subject to the requirements of GDPR.
The Client and Intuit are the data controller under the Directive for any Source Data file containing Personal Data, meaning that such party controls the manner such Personal Data is collected and used as well as the determination of the purposes and means of the processing of such Personal Data.
AccSource is not responsible for the content of the Personal Data contained in the Source Data files stored on its servers at the discretion of the Client.

A "cookie" is a packet of information that allows our AccSource server (the computer that hosts our web site) to identify and interact more effectively with your computer.
Cookies are widely used by many internet sites including banks and airlines and hotel reservation systems, and their correct use is fundamental to the way these websites work. We automatically trigger SSL encryption when clients, suppliers and staff log into and use the Members area of our website, including during the transmission of source document files and completed work files.
SSL encryption is simply intended to help ensure that your experience with AccSource is always safe and secure.
You should note that general email communications may be subject to the same security risks as when you contact anyone else by email. For this reason, you should not include confidential information in any email to any person (and not just us). If you wish to securely communicate confidential information to us by email, we are happy to accommodate this if you can contact us in advance.

a variety of additional physical security measures in place to

Our Operations Centre in Chennai City, India occupies professionally managed office facilities on a par with Western standards. The building and our offices are covered by 24/7 security personnel.
NPP 9 – Cross-border transfer of personal information
Personal information may be sent outside of Australia under the National Privacy Principles, and Section 9 provides guidelines on these activities.
Part of this provision is that Information may be sent overseas if the receiving organization is bound under contract to the National Privacy Principles. AccSource fully complies with the National Privacy Principles without exception, and we make this written commitment in all our client contracts and appointment letters.
